My mother has recently had a stroke and has been asked by a notaire in France to sign a legal document (Power of Attorney). Surely there must be some special formality given her condition? |

Thanks for the enquiry. If your mother is resident in France then the
position is that provided your mother has full mental capacity but is
physically unable to sign the documentation the documentation should be
signed in her presence by two witnesses or in the presence of another
notaire who sign on her behalf confirming that she is unable to sign in
her own capacity by virtue of her physical incapacity.
If she is resident in the UK then the formalities must be in compliance
with the requirement of English law. |
